THE ONLY CONDITION IS TO ACCEPT ALL THE TERMS OF THIS CONTRACT. THE TERMS OF THE HEREBY CONTRACT ALSO APPLY TO ALL OF THE SERVICE UPDATES. OTHER CONDITIONS COME WITH THESE UPDATES AND SERVICES. IN THIS CASE, THE LATTER APPLY. THIS IS A LEGAL AND MANDATORY CONTRACT BETWEEN YOU AND ROCKET HOSTING. YOU CAN ACCEPT THE TERMS OF THE HEREBY CONTRACT: BY CREATING AN ACCOUNT OR JUST BY USING THE SERVICE. IF YOU REFUSE THESE CONDITIONS, DO NOT CREATE AN ACCOUNT OR DO NOT USE THE SERVICE.

Description of the Service

The Service enables you to store and retrieve your files and other data on Rocket Hosting's system via the website and through many access methods during the period of validity (defined below), according to the space of SSD HOSTING provided with your Plan. You can access your data and handle it from any computer via the Web access. Rocket Hosting provides you the storage room included in the Plan. If you choose to use the Service, you must follow the whole service activation procedure.

Terms of the contract

a) The content of this site, including the text, graphics, logos, icon buttons, pictures and software, is the property of Rocket Hosting or its content providers and is protected by international copyright laws. The programs of this site are also the property of Rocket Hosting or its software suppliers and are protected by the international laws on copyrights. Any reverse engineering, program decompilation or disassembly is strictly prohibited by Rocket Hosting, unless an explicit authorization is given.
b) Connection and Service availability. You are entirely responsible for the purchase and the maintenance of the Internet and telecommunication services and peripheral equipment required to access and/or to use the Service. Rocket Hosting cannot be held responsible for any brief interruption caused by normal scheduled maintenance, by maintenance for critical problems or by anything beyond its control.
c) You are entirely responsible for authorizing the users and exercising control and supervision. You are responsible for their access rights and their privileges. Rocket Hosting is not responsible for data deletion nor for any problem caused by the users.
d) The SSD HOSTING can email notification messages to the customers. It can also provide notices pertaining to changes made to the product's terms of use or to other subjects by posting notices or links directing to these, that are usually about the services provided.
e) Rocket Hosting expects its clientele not to ever use its services to conduct illegal activities. Rocket Hosting does not analyze the contents sent on the servers. However, if the authorities legally demand these documents, Rocket Hosting will have no alternative but to comply.
f) Rocket Hosting is not taking responsibility for any direct or indirect, special, accidental or consequential damage (including the loss of business activities, profit, saved data or any similar element) based on a breach of contract, a fault (including negligence), a fact of the product or on any other incident, and this, even if Rocket Hosting or its representatives have been warned of a possible damage and that the remedial action is vain.
g) Account closure: after the closing of an account, the supplier retains the files on the servers for a maximum of 60 days. The client can retrieve his data via online support.
h) All the softwares offered by Rocket Hosting are provided as they are, without any guarantee; Rocket Hosting is not responsible for any damage due to their use. Moreover, Rocket Hosting disclaims the obligation to carry any guarantee, whether it is explicitly or implicitly formulated.
i) Rocket Hosting reserves the right to modify at all times the services offered (or a part of it) to its clients or to terminate permanently or temporarily a service and this, with prior notice.
j) The customer's commitment is effective after validation of the online general terms and conditions.
k) The online general terms and conditions overrides the printed general terms and conditions. The parties agree that Rocket Hosting can modify its service without any further formalities, said modifications to be in the online general terms and conditions.
l) For any denial concerning the construction or the interpretation of the hereby conditions, the parties explicitly agree that they can refer to the application of Canadian laws.
m) By downloading the softwares offered by Rocket Hosting, the client declares to have read the general terms and conditions and that he agrees with all of the terms. Furthermore, the client declares to be authorized by his employer to commit to the supplier within the context of this agreement.

EXCLUSION OF GUARANTEE

a) AS PERMITTED BY THE LAWS IN FORCE, THE SERVICE AND ANY SOFTWARE OR SERVICE OFFERED BY A THIRD PARTY ARE PROVIDED "AS IS" AND "DEPENDING ON THE AVAILABILITY", AND MAY CONTAIN FAILURES. Rocket Hosting AND ITS LICENSERS DO NOT GUARANTEE THAT THE SERVICE WILL NOT BE WITHOUT INTERRUPTION OR FREE FROM FAILURES. NO ADVICE OR INFORMATION WILL BE PROVIDED BY Rocket Hosting TO ITS LICENSERS, ITS SUBSIDIARIES, ITS AGENTS OR ITS SUBCONTRACTORS. THEIR RESPECTIVE EMPLOYEES WILL NOT MODIFY THE TERMS OF THE HEREBY CONTRACT NOR SERVE AS GUARANTEE. Rocket Hosting IS UNDER NO CIRCUMSTANCES RESPONSIBLE FOR ANY TAMPERING, INAPPROPRIATE USE, MISUSE, NEGLIGENCE OR ILLEGAL USE OF THE SERVICES BY THE USER, FORTUITIOUS EVENTS, ANY REPAIR, ALTERATION OR MODIFICATION BY A THIRD PARTY, ACCIDENTS, WARS,TERRORISM, ACTS OF VANDALISM, NATURAL DISASTERS AND BAD WEATHER AS PERMITTED BY THE LAWS IN FORCE.

LIMITATION OF LIABILITY

a) AS PERMITTED BY THE LAWS IN FORCE, FOR ANY CLAIM CONCERNING DAMAGES RESULTING FROM SERVICES MENTIONNED OR NOT MENTIONNED HEREIN, YOUR ONLY RIGHT OF RECOVERY IS LIMITED TO ALL CHARGES PAID TO Rocket Hosting CORRESPONDING TO THE MONTH PRIOR TO THE OCCURRENCE OF THE EVENT THAT RESULTED IN A CLAIM. Rocket Hosting'S RESPONSIBILITY FROM THIS CONTRACT OR RELATED TO IT WILL NEVER EXCEED THE TOTAL AMOUNT OF THE CHARGES PAID TO Rocket Hosting UNDER THE TERMS OF THIS CONTRACT, AND THIS, DURING THE MONTH PRIOR TO THE EVENT THAT RESULTED IN A CLAIM ("MAXIMUM OF DAMAGES").
b) Rocket Hosting AND ITS LICENSERS DISCLAIM ALL RESPONSIBILITY IN CASE THAT THE CHANGES MADE TO THE SERVICE REQUIRE NEW EQUIPMENT, REDUCE THE SERVICES OR THE EQUIPMENT PERFORMANCE OR MAKE THE EQUIPMENT OBSOLETE.
